Mediation and complex civil litigation


Mediation is a type of alternative dispute resolution (ADR) and an effective way of resolving litigation. A neutral third-party, the mediator, works with you and the opposing party to determine if there is any middle ground for a settlement. Mediations are confidential, so what is discussed in mediation won’t be admissible in court.

Some courts require parties to engage in ADR before a trial is set. Mediation is usually the most common type of ADR, and for good reason. It’s confidential, cost effective, and allows you to help craft a settlement agreement. Mediated settlement agreements can offer more creative solutions than would be traditionally available in a court-issued judgment.

Although parties might be ordered to attend mediation, the parties aren’t required to come to an agreement. If mediation is unsuccessful, then the case continues and goes to trial.
